Billing Authorization
I represent and warrant that if I am purchasing something or paying for a service from FR3RUNNING or from other merchants through FR3RUNNING, that:
- Any credit card or bank account draft (ACH Draft) information I supply is true and complete.
- My credit card company or financial institution will honor the charges I incur.
- I will pay the charges I incurred at the posted prices, including applicable taxes, fees, and penalties.
I hereby authorize FR3RUNNING to charge my ACH draft or credit card account. I understand that a 14-day written notice is required to terminate billing. I acknowledge that FR3RUNNING will provide clear and conspicuous notice regarding the automatic renewal terms in compliance with California’s automatic renewal law (Cal. Bus. & Prof. Code § 17600 et seq.). I am responsible for payment whether or not my student attends classes until I notify FR3RUNNING in writing to drop my student from class(es).
Should I dispute a charge through my financial institution, this will constitute a breach of contract unless a resolution process is followed. Disputes must be submitted to FR3RUNNING in writing within 30 days of the charge, allowing FR3RUNNING to resolve the dispute before any further actions. Failure to follow the resolution process may result in penalties, additional fees, collection, legal action, and/or termination of current and future services.
Annual Fees and Refunds
1. Annual Fee:
All students will be charged an annual fee of $75, payable at the start of each calendar year. This fee covers administrative costs and program enhancements. By California law, the annual fee is disclosed, and its intended use is fully specified.
2. Non-Refundable Fees:
The following fees are non-refundable to ensure clarity and prevent disputes:
• Initial Registration Fee: Due upon signing up for the program.
• Deposits: Any deposits made for equipment, uniforms, or other program requirements are non-refundable.
3. Monthly Class Payments:
Class payments are due on the 25th of each month, covering the following month’s participation. Payments can be made through an authorized ACH draft, credit card payment, or other approved method specified by FR3RUNNING. Clients must ensure timely payments to avoid disrupting the student’s class participation.
Makeup Classes and Account Balance: Makeup classes benefit students; however, makeup classes may not be honored if the account has a past-due balance. All outstanding payments must be resolved to qualify for makeup classes.
4. Missed Payments and Refund Policy for Classes:
• Missed Payments: If a payment is missed or fails to process by the due date, a late fee may apply as specified in the “Late Payment and Failed Payment Policy.”
• Class Cancellations by Client: If a client wishes to cancel their child’s enrollment in classes, they must provide at least 14 days written notice before the start of the next billing cycle. Failure to provide timely notice may result in responsibility for the next month’s payment.
• Class Cancellations by FR3RUNNING: Should FR3RUNNING need to cancel classes for unforeseen reasons (e.g., facility closures, health or safety concerns), clients will be notified promptly and offered either make-up classes, credits towards future classes, or prorated refunds (If requested and approved)
5. Notice of Fee Changes:
FR3RUNNING reserves the right to adjust the annual fee, registration fee, or class payment rates. Clients will be given at least 30 days’ written notice of any fee changes under California’s consumer protection laws.
Drop Procedure
Parents may drop a student from class by sending written notice via email, regular postal mail, or online form. FR3RUNNING will confirm the notice within 14 business days. The student is expected to continue attending classes during these two weeks, and regular billing will apply. If notice is not provided at least two weeks in advance, parents will be responsible for any charges incurred during the next billing cycle. This process follows California law, ensuring transparent terms.
Late Payment and Failed Payment Policy
Payments are due by the 25th of each month, the specified date in your billing cycle. A $25 late fee will apply if payments are not received by the 5th day of the month. Failed ACH or credit card payments must be corrected within seven days, or services will be suspended. Continued failed payments may result in membership termination. Clients may appeal late fees within 30 days by submitting a formal request.
Payment Method Changes:
Clients may update their credit card or ACH payment information by notifying FR3RUNNING. Changes must be submitted seven days before the next billing cycle to ensure timely processing.
All penalty fees are disclosed in compliance with California law to ensure they are reasonable and clear to clients.
Behavioral Policy and Code of Conduct
All participants, parents, and guests must strictly adhere to FR3RUNNING’s Code of Conduct. This Code ensures all individuals’ safety, respect, and well-being within the parkour gym environment. Failure to comply may result in disciplinary actions, including suspension or termination of services without a refund. The key behavioral expectations are as follows:
1. Respect for Staff and Participants:
• All individuals must show respect to FR3RUNNING staff, coaches, and fellow participants at all times. This includes following instructions, addressing staff appropriately, and maintaining a positive attitude during classes and events.
• Disrespectful behavior towards staff or peers, including arguing, defiance, or name-calling, will not be tolerated.
2. Safety Instructions:
• Participants are required to follow all safety instructions given by staff, including but not limited to proper use of equipment, adherence to spotting techniques, and staying within designated areas for training.
• Participants who fail to follow safety instructions and put themselves or others at risk may be temporarily removed from class and, in severe cases, suspended from further participation.
3. Disruptive Behavior:
• Disruptive behavior, such as running in unauthorized areas, roughhousing, or interrupting classes, is strictly prohibited. Participants must maintain discipline during instruction and respect the learning environment for others.
• Repeated disruptions will result in warnings and removal from class if the behavior continues.
4. Prohibited Conduct:
• Physical Intimidation or Violence: Any form of physical aggression, such as pushing, hitting, or intimidating others, is grounds for immediate suspension or termination.
• Verbal Abuse: Participants, parents, and guests must refrain from using offensive language, insults, or raising their voices aggressively.
• Online Harassment or Cyberbullying: Inappropriate behavior extends beyond the gym. Any online bullying, harassment, or sharing of harmful content related to FR3RUNNING participants or staff will not be tolerated. This may lead to suspension or termination of membership.
5. Bullying and Harassment:
• Zero-Tolerance Policy: FR3RUNNING has a zero-tolerance policy for verbal, physical, and emotional bullying. This applies to participants, siblings, parents, and guests.
• Bullying includes, but is not limited to:
• Name-calling, teasing, or making fun of others.
• Excluding individuals from activities or social interactions.
• Threatening or causing physical harm.
• Using power or popularity to control or manipulate others.
• Spreading rumors or gossip.
6. Reporting Procedure:
• All instances of bullying or harassment should be reported to FR3RUNNING staff immediately. Participants, parents, or witnesses can make reports and will be handled with confidentiality and care.
7. Consequences of Violations:
• Violations of the Code of Conduct, especially incidents involving bullying, harassment, or unsafe behavior, will lead to disciplinary actions as outlined in California’s anti-bullying laws.
• FR3RUNNING reserves the right to bypass the warning process and immediately suspend or terminate services in cases of severe or dangerous behavior.
8. Parent and Guest Responsibility:
• Parents and guardians are expected to model appropriate behavior for their children by following all gym rules, maintaining respectful interactions with staff, and ensuring timely drop-offs and pickups.
• Guests, including siblings and visitors, must follow all FR3RUNNING policies while inside the gym or at events. Parents are responsible for ensuring that siblings or guests do not disrupt classes or compromise safety.
Waiver and Liability Release
1. Acknowledgment of Risk and Assumption of Responsibility:
By allowing my child to participate in parkour training, classes, camps, and other related events and activities at FR3RUNNING, I acknowledge and understand that these activities carry inherent risks of physical injury, property damage, illness, and exposure to communicable diseases (including, but not limited to, COVID-19). These risks include, but are not limited to, falls, collisions, physical exertion, and the potential for unforeseeable accidents that may result in serious injury or even death.
I, on behalf of myself and my minor child, assume full responsibility for my voluntary participation in these activities and agree to comply with all safety instructions, guidelines, and policies set forth by FR3RUNNING staff.
2. Waiver of Liability and Release:
In consideration of the services provided by FR3RUNNING, its staff, coaches, agents, volunteers, representatives, and affiliates, I hereby voluntarily agree to release, waive, discharge, and hold harmless FR3RUNNING from any claims, demands, causes of action, damages, or liability of any kind that may arise from or relate to my child’s participation in FR3RUNNING activities, including claims related to injury, death, loss of property, or any other harm that may result from negligence, except to the extent prohibited by California law.
3. Indemnification:
I agree to indemnify and hold harmless FR3RUNNING, its staff, coaches, agents, and affiliates against any claims brought by third parties (including family members, other participants, or guests) that may arise from my child’s participation in activities or the use of FR3RUNNING facilities, including claims for medical expenses, damages, legal fees, or other losses.
4. Medical Treatment Consent:
In the event of an emergency or injury to my child, I consent to the provision of emergency first aid and medical treatment as deemed appropriate by FR3RUNNING staff. I understand that FR3RUNNING is not responsible for the cost of any medical treatment, emergency transportation, or other related services provided.
5. California Legal Notice:
I acknowledge that California law has specific guidelines regarding the enforceability of waivers and liability releases, particularly for activities involving minors and claims of gross negligence or intentional harm. I understand that this waiver does not release FR3RUNNING from liability for its gross negligence, willful misconduct, or law violations, as prohibited under California Civil Code Section 1668.
6. Parental Certification and Understanding:
By signing below, I certify that I am the parent or legal guardian of the minor participant and that I have read and fully understood this waiver and liability release. I certify that I am fully aware of the legal consequences of signing this document, including the waiver of my right to bring legal claims against FR3RUNNING on behalf of myself or my child, except as specifically prohibited by California law.
Privacy Policy
FR3RUNNING is committed to protecting your personal information. We collect only the data necessary for registration, billing, and communication and will never share your information with third parties without your consent. In the event of a data breach, FR3RUNNING will notify affected clients within 48 hours of discovery and will take immediate steps to mitigate risks, consistent with California’s data privacy requirements.
